This list is voluntary, in that by law we cannot require compliance of Realtors. We do ask them, however, to
voluntarily respect the wishes of residents who choose to place their names on this list.
South Holland's Real Estate Solicitation ordinance was rescinded in 1999 after the Village Board entered into a
historic agreement with the South/Southwest Association of Realtors® on April 5, 1999. The agreement established a Local Joint Commission which meets to discuss real estate issues, develop and review education and marketing plans, and deal with complaints.
The ordinance was rescinded because of a prior ruling issued by the Seventh Circuit Appellate Court declaring the State of Illinois non-solicitation law to be unconstitutional. The ruling was not applicable to local non-solicitation ordinances such as ours. However, all local ordinances of this type, including South Holland's, were placed in jeopardy. Municipal attorneys advised us that defending our ordinance against litigation that was certain to come would be extremely costly, with no guarantee that the courts would uphold our position.
We believe substantial tax dollars were saved by not entering into risky and costly litigation. We also believe resident interests were protected by establishing the Local Joint Commission.
In short, the courts have declared that real estate brokers have as much legal right to distribute solicitation materials as do persons soliciting to sell insurance or lawn care services. The purpose of realtor mailings is simply to let you know of their presence in the community and their desire to be of professional service to you, whenever that need might arise. It is not intended to suggest that "now" is a good time to move or sell.
South Holland is a vibrant, growing community. Take a look around you... new homes... new business and commercial
developments... all of these are good and healthy signs. We will continue to maintain a real estate "non-solicitation" list. But because of the court's rulings, we cannot require Realtors to avoid mailing to persons whose names appear on the list. However, we do ask them to voluntarily respect the wishes of residents who choose to place their name on such a list.
